AULTCOMP PRIVACY POLICY

We know that your privacy is important to you, and that is why we have taken many steps to ensure your personal information is protected. Executive Order 2007-SB7, enacted in October 2006, made nearly all information contained in a BWC claim and risk files not public record and therefore not available to anyone other than the parties to the claim without a release from a party to the claim.

USES AND DISCLOSURES OF YOUR PROTECTED HEALTH INFORMATION

Your Authorization. Except as outlined below, we will not use or disclose your protected health information for any party that is not related to your claim or for any purpose unless you have signed a form authorizing the use or disclosure.

Disclosures for Treatment. We will use your protected health information as necessary for your treatment. For instance, AultComp MCO may request certain documents of protected health information from a provider or health care facility involved in your care to process requests from your provider for treatment.

Uses and Disclosures for Payment. We will make uses and disclosures of your protected health information as necessary for payment purposes. For instance, we may use information regarding your medical procedures and treatment to process and pay bills and/or to determine whether services are medically necessary and appropriate as specific to your workers’ compensation claim.

Family and Friends Involved In Your Care. With your consent we may discuss your claim and healthcare needs with an individual you designate. If you are incapacitated, or facing an emergency medical situation and we determine that a limited disclosure is necessary to facilitate your care. We may share limited protected health information with a family member or significant other until such a time as you can participate in the management of your claim and/or medical care. If you choose not to collaborate with our staff we will continue to manage your claim through communication with other parties to the claim, as required by the Ohio Bureau of Workers’ Compensation.

Communications with You. We may communicate with you, your representative, your employer, their representative, service providers.
and/or the Ohio Bureau of Workers’ Compensation regarding your workers’ compensation claim. You have the right to request to receive communications regarding your protected health information from us by alternative means or at alternative locations. For instance, if you wish messages to not be left on voice mail or have an alternative phone number, we will accommodate reasonable requests.

Other Uses and Disclosures. We are permitted or required by law to make certain other uses and disclosures of your protected health information without your authorization.

Access to Your Protected Health Information. You have the right to copy and/or inspect much of the protected health information that we retain on your behalf. All requests for access must be made in writing and signed by you or your representative. You may also access your claim file by logging onto Ohio BWC and setting up an account.

Complaints. If you believe your privacy rights have been violated, you can file a complaint by writing to the Complaint Coordinator; AultComp MCO, Inc. 4650 HIlls & Dales Rd NW Suite 360 Canton, Ohio 44718 There will be no retaliation for filing a complaint.

  • We may release your protected health information for any purpose required by law;
  • We may release your protected health information for public health activities, such as required reporting of disease, injury, and birth and death, and for required public health investigations;
  • We may release your protected health information as required by law if we suspect child abuse or neglect; we may also release your protected health information as required by law if we believe you to be a victim of abuse, neglect, or domestic violence;
  • e may release your protected health information if required by law to a government oversight agency conducting audits, investigations, or civil or criminal proceedings;
  • We may release your protected health information if required to do so by a court or administrative ordered subpoena or discovery request; in most cases you will have notice of such release;
  • We may release your protected health information to law enforcement officials as required by law to report wounds and injuries and crimes;
  • We may release your protected health information to coroners and/or funeral directors consistent with law;
  • We may release your protected health information if you are a member of the military as required by armed forces services; we may also release your protected health information if necessary for national security or intelligence activities; and RIGHTS THAT YOU HAVE
